Transfer of value: Dr Lucas-Schloetter analyses Commission’s proposal
Dr Agnès Lucas-Schloetter, a senior lecturer and researcher at the Chair for Civil Law, Intellectual Property and Competition Law at the Ludwig-Maximilian University, published an appraisal of the Draft Copyright Directive’s provisions on transfer of value (Recitals 38, 39 and Article 13).
In this analysis, she looks in particular at the compatibility of the Commission’s proposals with international and EU law, more specifically the E-Commerce Directive and the Charter of Fundamental Rights. With sound and solid arguments, Dr Lucas-Schloetter provides answers, rebutting criticism and making a clear case for why this proposal is compatible with both EU and International law.

Dr Agnès Lucas-Schloetter is senior lecturer and researcher at the Chair for Civil Law, Intellectual Property and Competition Law at the Ludwig-Maximilian University. She is also affiliated to the Sorbonne Department of Intellectual Property and to the Center of Studies and Research in Intellectual Property (Cerdi) of the University Paris Saclay. She graduated in law at the University of Nantes, holds a PhD in law from the University Panthéon-Sorbonne and graduated with a French Habilitation from the University Paris Sud. Her main field of interest includes European and comparative copyright law, an area in which she has written numerous publications. She is co-author of a leading French commentary on copyright law, the “Traité de la propriété littéraire et artistique” (LexisNexis). Her recent publications include an article on the new German copyright contract law (GRUR 2017, 235), a comparative study on the remuneration of authors and performers (in Torremans (ed.), Handbook of Copyright, 2017, forthcoming), and an essay about the share of publishers in private copying levies (International Review of Copyright Law, RIDA 2016).
